The need for timely conflict resolution and problem solving in the fast paced world is a must.

As a practicing attorney for over forty years it has become clear that differences between or among persons or business entities is inevitable. That the differences arise is not the problem. The problem is failing to deal with them and letting them fester. The opportunity to deal with them can and should occur before they ripen into conflict or litigation. Mediation offers the opportunity to craft a solution they can live with and trust, to determine the timing of the process, and to avoid the distraction and cost of protracted litigation.

Having had a litigation practice for many years, I have been involved in mediation both as a mediator and representative of parties to the mediation. The experience of having been on all sides of the process has given me a broad perspective helpful to the process and the participants.

Life is Full of Situations with Opposing Opinions
Stowe Reporter, Aug 2019

As Town Moderator for ten years I have guided the voters of the Town of Stowe through civil discourse as they gather for their annual Town Meeting where decisions about what is favored and what is not are made. In the process, the voters advocate for their respective positions, but not at the expense of others. All the while I ask that they keep in mind that there is an immense gap between saying I am right and I believe I am right, and that people with whom they disagree are good people who have hopes and dreams as high as theirs. In the end, it is more important to recognize that respecting each other and being able to work cooperatively is more important than any differences that they may have.

Mediation can and should follow much the same pattern where participants arrive at outcomes on terms and conditions crafted by them and with which they are prepared to adhere. Outcomes arrived at by those involved will better suit their needs and are more likely to endure. The Spanish poet Antonio Machado wrote “There is no road, the road is made by walking.” Likewise,there are no standard solutions to problems, they must be forged.


Areas of Practice


Marital and family issues

Few events in life carry the pain and disruption that accompany issues relating to separation, divorce and custody of children, and the forces that drive them. I have handled all facets of marital and family issues so I understand them and have the patience to work with people at very difficult times in their lives enabling them to forge solutions and ways of living going forward.


Traumatic injuries

Mediating issues involving severe injuries of traumatic origin whether from medical negligence, industrial accidents, motor vehicle crashes or sexual abuse requires familiarity with the medical, emotional and economic aspects of cases such as these. I have handled, tried and settled cases in all of these categories and have the understanding necessary to mediate them.


 


when and Why to use Mediation

Timing for pursuing mediation is important.  When it becomes clear that differences are not able to be resolved, the risk of a festering conflict, becomes the danger.  Mediation should be considered as soon as the need to resolve the differences arises, while the parties retain control over the decision making process.  Mediation should begin as soon as the parties have an understanding of the facts and issues, and have a perspective worthy of discussion.  Early resolution brings closure crafted by the parties allowing energy and resources to be focused on other matters.
